Our Agreement

When you book a Bodyboarding Holiday, a contract is made when your booking is confirmed in writing or via e-confirmation letter from the company.

Full payment should be paid at time of booking. For your financial security all funds will be held by a third party trust account, in compliance with the Package Travel, Package Holidays and Package Tours Regulations 1992 (SI 1992 No 3288), until completion of your surf holiday (see Client Protection). The Lead person signing the booking form accepts responsibility for payment for everyone listed on the booking and is responsible for ensuring that all other persons listed on the booking form have read the booking conditions below and are aware of the booking details.

Flight Arrangements

With so many great offers from online agents and the ever changing fares, flights should be arranged through an ABTA or ATOL bonded travel agent.

Your contract for the flight arrangements is not with the company and as such the company cannot be held responsible for any delays or other problems which may arise with your flights.

Flight Details

If we do not receive your flight details prior to a week before your departure you will be responsible for paying and organising for your own transport to the accommodation.

Airport Arrival

Our representative will be waiting for you to arrive in the arrivals area of the destination airport. We request that after you have collected your bags you walk in to the arrivals area and meet our representative. If you leave the airport without meeting your representative and incur costs you will be liable for them yourself. If your flight is delayed (or cancelled), or you miss your flight and you do not arrive with in time to meet your transfer you will have to pay for your own transfer to the destination. This includes taxi’s, boats and any other transport or costs that would have usually have been covered if you had met at the agreed time. We will help you to organise this. You must stay in touch with us regarding your arrival time to allow us to do this.

Early Arrival Or Late Departure

If you arrive in the location before the first day of the trip or after the first day of the trip you are liable for the cost of the connection to the accommodation. If you leave earlier than the last day of the trip or you fly home after the last day of the trip it is your responsibility and at your cost to arrange your return travel to the airport.

Getting To The Airport On Time

It is your responsibility to get to the airport on time in order to catch your flight to the trip destination. It is your responsibility to prepare accordingly taking in to consideration the weather, traffic, strikes, runway or airport closures etc. If you do not make it to your flight Bodyboard Holidays accepts no liability and you default on your trip with us. Please watch the weather and news if it looks like snow is forecast please leave days earlier to get to the airport. It is your responsibility to ensure that you have arranged flights to the correct location on the correct date.

Changing Your Booking

We will make every effort to arrange any changes you request for your booking, however any changes to your booking will incur a standard administration fee of £100 for a Bodyboard Holiday or Bodyboard Coaching Weekend which is payable immediately.

Bodyboard Holidays reserves the right to move or change holiday/weekend dates due to any unforeseen circumstances. We will endeavour to help facilitate these changes with you and keep you informed of any issues that would cause a change in dates as soon as they are known to us.

If FCO (Foreign and Commonwealth Office) guidelines change on the run-up to your trip and advise against travel to your destination is made, your trip will be cancelled and you should contact your personal travel insurer to reimburse your trip and flight costs.

Cancellations

All cancellations must be sent in writing and will be effective on the date which they are received by the company. Cancellation charges are payable as follows:

Period before departure we are notified – Percentage of total cost payable

  • If you cancel 12 weeks or more before the trip we retain 50% of the total cost
  • If you cancel with less than 12 weeks before the trip then its 100% of the total cost

However if your cancellation is within the terms of your insurance policy, you may be able to make a claim.

Enrolment Forms

PLEASE NOTE: ENROLMENT FORMS MUST BE COMPLETE 30 DAYS BEFORE THE TRIP START DATE. FAILURE WILL RESULT IN A £100 ADMIN FEE BEING CHARGED.

At Bodyboard Holidays, the well-being and safety of our guests are our top priorities. Completing an enrollment form well in advance of your scheduled time with us is crucial. This allows us to adequately prepare for your arrival, take note of any medical conditions or dietary requirements you may have, and assess your bodyboarding proficiency. These are important health and safety requirements that we need to plan in to our trip. This has implications on the instructors that we use and sees that you are placed in the most suitable group for your skill level and will visit the most suitable waves and beaches each day.

It is essential that you submit your completed forms no later than 30 days before the commencement of your trip. This timeframe provides us with the opportunity to make necessary preparations and adjustments to cater to your specific needs. Failure to submit the form within this period will result in a £100 administration fee. This fee covers the additional costs associated with processing your information after the designated deadline. If you book under 30 days before the trip we require the form to be returned in 24 hours after your booking payment has taken place.

Payment

Payment in full is required to secure your place on a Bodyboard Coaching Weekend or Bodyboard Holiday. This is taken either over the phone with a credit or debit card, cash, or via our online invoicing facility. In some circumstances we can accommodate a payment plan. In this instance your place will be secured after the first instalment has been received. You will be emailed your payment plan which will include the dates for each payment. The payments will automatically be taken on the specified dates from the initial payment card. We will need a minimum of 7 days’ notice to amend a payment date or which card is to be debited. Payment in full must be received no later than 12 weeks prior to departure. If payment is not received within this time frame your place on the trip will be forfeited.

Insurance

As with any holiday, full travel insurance is a requirement for all guests booking a trip with the company. Please also ensure that your policy covers you for ‘disruption to travel’ and ‘cover for cancellations’ as standard.

You may need to add additional cover for surfing/bodyboarding, it is essential that your insurance policy covers you for all these. Failure to take out travel insurance breaks the contract between Bodyboarding-Holidays and the client.

If you are joining one of our trips and you are native to the country where the trip is being held (i.e you live in America and are joining our California trip) you do not need medical travel insurance as long as you have your own personal health-care plan or are covered by your country’s National Health Service. Although, we request that you still take out trip disruption and cancellation insurance to cover all possible eventualities.

For travel to areas with limited medical facilities, for example Southern Sumatra, please ensure your insurance is sufficient.  It should include Medi-Vac cover.

Suppliers’ Conditions

Suppliers will often have their own booking conditions or conditions of carriage, and you will be bound by those as far as the relevant supplier is concerned. Some of these conditions may limit or exclude liability on the part of the relevant supplier, or give the supplier the right to alter or cancel arrangements without penalty.

Where relevant, copies of such conditions will be available for inspection at our offices, or at the offices of the relevant supplier.

Client Protection

All monies paid to the Company will enter a trust account, in compliance with the Package Travel, Package Holidays and Package Tours Regulations 1992 (SI 1992 No 3288), which is supervised by an independent trustee – Bodyboard Client Account with Lloyds TSB Bank, Central Square, Newquay, Cornwall, UK.

Your funds are held in this account and may not be released until you have returned from your holiday. In the unlikely event of the company becoming insolvent, your payment is protected by the company’s trust account, so your peace of mind is guaranteed. This means that your money will be refunded in the extremely unlikely event of our insolvency.

Not Included In The Cost

Cost of passports, visas where required, gratuities (except where indicated), insurance, flights, excess baggage, laundry, drinks, airport taxes, meals (except where indicated), insurance, airport transfer, car hire and items of a personal nature.

Surf Conditions

Our camps are selected for the quality they offer but as a company we are not responsible for poor surf or bad weather. We select our resort so they perform above average and that they offer good natural environment but if no surf occurs then we cannot offer compensation or alternatives. We provide details of conditions on our website introductory pages but it is your responsibility to ensure that all conditions are researched by you and that you are happy with the resort selection.

Weather / Surf Conditions Bodyboard Weekends

In the event of flat waves or stormy conditions for a bodyboard coaching weekend we will offer alternative activities to see you get the most out of the available ocean conditions. This may include SUP, Coasteering, Kayaking etc. We will adjust the format of the weekend to get the most out of the available conditions, for example choosing to run all of the sessions on the Sunday if that is when the waves are at their best. The organisers will supply as much notice as is possible under the circumstances and if conditions demand, a coaching weekend may be postponed until more suitable dates. If it is impossible to offer a water-based activity, a voucher can be supplied for these sessions. Please be open-minded, we are dealing with mother nature!

Environmental Dangers

As a surf holiday our courses involve a natural environment that we do not control these include but are not limited to snakes, sharks, avalanche and volcanic eruptions to name a few. The company cannot be held responsible for these activities or the dangers that you as a customer will experience. We try our best to ensure safety comes first always but natural things will occur and caution must be taken at times. It is understood that you agree to these dangers when booking.

Contests

Please note that the organisation of the IBA contests is conducted by the IBA and therefore the date and location for the contests can be changed by IBA at their discretion at any time. Therefore we cannot guarantee participation as a spectator at this event.

Our Liability

(i) Our obligations are limited to providing the courses and these and the suppliers providing any service or facility included in your holiday, are to take reasonable skill and care to arrange for the provision of such services and facilities and, where we or your supplier is actually providing the service or facility, to provide them and to do so with reasonable skill and care.

You must show that reasonable skill and care has not been used if you wish to make any claim. Standards of, for example, safety, hygiene and quality vary throughout the transport and destinations that your holiday may involve. Sometimes these standards will be lower than those which would be expected to be found in the UK.

The services and facilities included in your holiday will be deemed to be provided with reasonable skill and care if they comply with any local regulations which apply (such as, for example, those of the Civil Aviation Authority), or, if there are no applicable local regulations, if they are reasonable when compared to the local standards and customs

Responsibility

The Company act only as agents for the hotels, contractor’s providing accommodation, transportation or other services, and all coupons, exchange orders, receipts, are subject to any and all tariffs, terms and conditions under which any accommodation, transportation or any other services whatsoever are provided by such hotels or contractors.

The Company shall not be liable or responsible for death or injury to any person so far as permitted by law or loss of or damage to any property or otherwise including baggage, whether due to its or its staff, agents or employees negligence or otherwise arising out of or in conjunction with any accommodation, transportation or other services, or resulting directly or indirectly from acts of God, dangers, incidents of the sea, fire, breakdown in machinery or equipment, acts of governments or other authorities, de jure or de facto wars, whether declared or not, hostilities, civil disturbances, strikes, riots, thefts, pilferage, epidemics, quarantines, medical or customs regulations, delays or cancellations of or changes in schedules or itinerary, or overbooking or defaults, or from any causes beyond the Company’s control or through the acts or defaults of the hotels, airlines, bus or car companies, railroads, steamship lines or owners or contractors providing accommodation, transportation or other services or any loss or damage resulting from improper or insufficient passport, visa or other documents and that neither the Company nor its staff, agents or employees shall be or become liable or responsible for any additional expense or liability sustained or incurred by the tour and/or modify the itineraries in any way it thinks desirable and further reserves the right to decline to accept any person on any tour and may substitute hotels where necessary.

The issuance and acceptance of receipts or tickets or accommodation shall be deemed consent of the above conditions. You will find the transportation companies or firms shall be exempt from all liability in respect of any detention, delay, loss, damage, sickness or injury, however, or by whomsoever caused and whatever kind occurring, of or to the passenger at any time when the passenger is not on board a carrier or conveyance used and operated by the transport companies or firms. The passage contract in use by the transportation companies or firms shall constitute the sole contract between the transportation companies or firms and the purchaser of these tours and/or passengers. You must check that your travel insurance covers you.

Privacy

Any information you provide to the company is held under the strictest security.

If you choose to book a holiday or request a quotation or resort information, we may keep your details on file to send you new versions of our newsletter or to give you details of special offers. We do not sell our customer details to anyone.

When you visit our site we do not use cookies to monitor your use.

If you wish us to remove any details we may have stored simply send an email to [email protected] with your full name, address, postcode and email address requesting that your details be removed. Please note that we are required by law to retain information on financial transactions we have had with our customers. If you have any further questions on our privacy policy please do not hesitate to contact us.

Surfing and Bodyboarding are strenuous sports and you need to be a competent swimmer. If you are in any doubt about your physical or mental fitness or swimming ability you should consult your doctor before booking your holiday and only proceed if you are advised that it is safe to do so. Any medical condition or disability must be notified to the company before booking and advice sought before the booking is made. It is your responsibility to keep healthy and safe on holiday and in particular make yourself aware of the need for sun protection and the dangers of over exposure to the sun.

Jurisdiction

All agreements will be made in England and be governed by English law and be subject to the exclusive jurisdiction of the English Courts.

COVID-19 Terms & Conditions

These set of terms & conditions replace the pre-existing terms and are applicable from 18th March 2022. They will remain in place until such time as the World Health Organisation declares the pandemic over and social distancing and travel restrictions are lifted.

Once these conditions are removed, all bookings will revert back to Bodyboard Holiday’s standard terms and conditions.

1. Check foreign travel advice for the countries you want to go to
Other countries have their own COVID-19 rules. Before you travel you should check the ‘Entry requirements’ section of foreign travel advice for all countries you will visit or travel through.

This will tell you if the country allows people to enter from the UK.

It should also provide advice on whether you will need to:

  • show proof of a negative COVID-19 test
  • quarantine on arrival
  • complete a passenger locator form to enter the country
  • show proof of vaccination status (plus any rules about vaccine expiry or vaccine boosters)
  • wear a face covering on your journey or on arrival

Check the ‘Entry requirements’ section of foreign travel advice for all countries you will visit or travel through.

2. Arrange any COVID-19 tests you will need to enter the countries that you will travel to
You cannot use an NHS test for this. You must use a private test provider.

3. Find out how you can use the NHS COVID Pass to prove your vaccination status abroad
Some countries require proof of vaccination status before you can enter.

Operator and transport hub rules
Your travel provider, or the transport hub you travel through, may have COVID-19 rules in place. For example they may require or advise you to wear a face covering.

You should follow any COVID-19 rules and guidance from:

your travel provider – airline, ferry, coach or train company
the transport venue – airport, port, coach or railway station
